Has the society opted for the 22% rate before?
Gross total income: all heads, after this year's set-offs, before 80P / section 149 and before any deduction in 'Other deductions' below.
Are the accounts audited?
Co-operative law audits almost every society.
Other deductions the 22% rate takes awayDefault ₹0 — most societies have none
Claimed from the income above, like the co-op deduction. Lost at 22%, and added back for the minimum tax.
Type only the part the 22% rate takes away. For 35AD that is the deduction less the normal depreciation you'd get instead.
Added back for the minimum tax, net of normal depreciation. Default 0.
80JJAA / section 146 is allowed at 22% too, so it is left out of this comparison.
Losses the 22% rate won't let you set offDefault ₹0
At 22% these can't be set off, so they are added back. Default 0.

Opting for 22% gives this credit up. Default 0.

How this works

We work out this year's tax at the co-op slabs, with the alternate minimum tax where it applies, and at the flat 22% rate. The break-even is the deduction at which the two are equal.

Rates for tax year 2026-27 are taken as unchanged from the 1961 Act.

The normal side: 10% on the first ₹10,000, 20% on the next ₹10,000 and 30% above, with a 7% surcharge above ₹1 crore and 12% above ₹10 crore (with marginal relief), plus 4% cess. Where the society claims other deductions, it pays at least 15% of income with those deductions added back; the co-op deduction itself is never added back.

The 22% side: 22% plus a flat 10% surcharge and 4% cess, with no co-op deduction, none of the other deductions, and no set-off of the losses that came from them.

The authorities:

  • FY 2025-26: the 22% option in section 115BAD of the Income-tax Act, 1961, exercised in Form 10-IF by the return due date; it cannot be withdrawn.
  • The minimum tax in section 115JC, which leaves 80P out of the add-back (section 115JC(2)(i)); the credit in section 115JD is lost on opting.
  • Tax year 2026-27 onward: section 203 of the Income-tax Act, 2025 — no Chapter VIII deduction other than section 146, exercised by the return due date, and never withdrawn (section 203(6)).
  • The 21 Nov 2026 return date for audited cases comes from CBDT Circular 07/2026.

This page does not compute total income, the co-op deduction, the 15% option for new manufacturers, interest, or the ₹10 rounding, and it does not file Form 10-IF.
